12-65   An ordinance amending the Zoning Ordinance (Ordinance No. 07-27) of the City of Harlingen:  To issue a Specific Use permit to Diana Garcia Padilla to allow a Farmers Market in a residential, single family (R1) District located at 19833 Morris Road, bearing a legal description of 20 acres out of Block 31, Lon c. Hill Subdivision, subject to:  (1) providing and maintaining the required paved parking in accordance with City regulations, and a plan coordinated with Texas A&M Kingsville Environmental Engineering, for off street parking constructed of pavers or other permeable surface to withstand the weight of fire trucks; (2) providing a maintaining the required landscaping in accordance with city regulations; (3) complying with all applicable handicapped accessibility requirements, and provide a handicap port-a-potty until existing house on site is remodeled; (4) comply with the current fire code; (5) providing a three compartment manual ware wash, employee lavatory, mop and sink and food safety training as per the Health Department; and (6) comply with requirements administered by the Planning, Engineering, Building Inspections, health and Fire Prevention Departments, prior to the issuance of the building permit and Certificate of Occupancy; providing for publication and ordaining other matters related to the foregoing.       09/19/12   10/03/12
12-66   Ordinance authorizing the issuance, sale and delivery of $2,280,000 in aggregate principal amount of “City of Harlingen, Texas Combination Tax and Revenue Certificates of Obligation, Series 2012” securing the payment thereof by authorizing the levy of an annual Ad Valorem Tax; approving and authorizing the execution of all instruments and procedures related thereto including a paying agent/registrar agreement and a purchase contract; approving the form of an official statement; and declaring an effective date.       09/19/12   10/03/12
  12-67   An Ordinance of the Governing Body of the City of Harlingen, Texas, amending the Code of Ordinances by amending Chapter 130 by adding Sub-Section 130.07, Unlawful Substances, to prohibit the use, purchase, possession, and sale of the synthetic drugs as categorized in Section 2A of the Texas Health and Safety Code as well as those substances categorized within United States Code, Title 21:  Controlled Substance Act.  Known or sold under such names as-but not limited to:”Spice,” “Genie,” “Dascents,” “Zohai,” “Sage,” “K-2,” “Blaze,” “Red Dawn” and “KO Knockout 2” to include newer synthetic drugs evasively marketed as, but not limited to; bath salts and/or plant food; providing a repealing clause; providing a savings clause; providing a severability clause; providing for penalty of fine not to exceed two thousand dollars ($2,000); and providing for an effective date.  10/13/12 10/17/12 
  12-68 An Ordinance amending the Zoning Ordinance (Ordinance No. 07-27) of the City of Harlingen: to issue a Specific Use permit to Sharon Diegal to allow a bar/lounge in a “General Retail (GR)” District located at 610 s. Lewis Lane, bearing a legal description of 1.69 acres out of blocks 2 and 3, Lewis Subdivision, subject to:  (1) maintain the required off street parking spaces; (2) providing a licensed security guard in the parking lot during peak hours of operation on Thursday, Friday and Saturday from 9:00 p.m. to 2:00 a.m. (3) maintain adequate lighting around all bar/lounge entrance exits, and on-site parking areas; (4) provide and maintain the surveillance video in the parking lot and must maintain a 30 day retention of the video; (5) providing and maintaining a 6 ft. solid fence along the south end of the property to provide a buffer from the residential use; (6) applicant must obtain and maintain TABC license; and (7) comply with requirements administered by the Planning, Building, Health, Fire and Police Departments, providing for publication and ordaining other matters related to the foregoing.  10/17/1  11/7/12
