The board shall have the power to provide for the ownership, establishment, operation and maintenance of a public municipal airport, provided that the operation and maintenance of the airport and all supporting properties appurtenant to it shall be under the supervision, control and authority of the board.

• Shall annually submit a budget to the City Commission of the City of Harlingen, Texas for approval and no expenditure of airport funds shall be made except in accordance with the approved budget or approved amendments to it.
• Shall make detailed monthly reports covering all phases of the operation and maintenance of the airport and supporting properties to the City Commission of the City of Harlingen
• Further, that the City Manager and the Mayor shall be ex-officio members of the Harlingen Airport Board.
• And that no provision hereof shall be construed to delegate to the Harlingen Airport Board any power not capable of being so delegated by law.
• All powers delegated shall be subject to any restrictions otherwise imposed by the laws of the State of Texas and the Charter of the City of Harlingen.

The Airport Board shall be composed of nine (9) members with not less than five (5) being residents of the City of Harlingen, and all being residents of Texas with each member to serve for a term of five (5) years.  The beginning and ending of each respective five year term for the five members appointed in 2002 through March 2005 who composed the board in existence in May 2006 when the 2006 Charter Amendment was adopted is to begin and terminate on successive years, whereby the term of each member of such Board shall begin and end in a year separate from the beginning and ending terms of the other members of the Board.  The four initial additional members to be appointed to the Airport Board after its expansion to nine members shall be appointed by the Mayor and approved by the City Commission for terms of approximately two, three, four and five years ending March 1, 2008, March 1, 2009, March 1, 2010 and March 1, 2011 respectively.  Successor appointments shall be appointed for five (5) year terms.  The beginning date of each successive term shall be on March 1.  On the expiration of each member’s term, a resident citizen of the city or state shall be appointed by the Mayor and approved by the City commission as the replacement appointment.  If a vacancy on the Airport Board occurs, such vacancy shall be filled by appointment by the Mayor and approval by the City commission of a resident citizen of the city or state to serve the remainder of the term of such vacancy.  In the event that upon the expiration of the term of any such Board Member his or her replacement is not succeeded by appointment by the Mayor and Commission as herein provided for, such member shall nevertheless continue as a member of the Board until a replacement appointment is in fact made by the Mayor and Commission as herein provided for, with such replacement appointment to terminate on the regularly scheduled date as herein provided for.
